Injured workers in New Jersey have three basic rights.
First, the right to receive temporary disability benefits, basically 70% of their gross weekly salary up to a maximum amount, if they are out of work for a total of 7 or more days due to a work injury.
Secondly, they have the right to have their medical expenses paid for emergency care and authorized medical care due to their injury.
Lastly, they have the right to receive monetary compensation in the form of a settlement for their permanent injury.
On occasion, employers are unfamiliar with the benefits of workers compensation insurance and simply don’t report a worker’s accident to the workers’ compensation carrier. Without an initial report of an accident, the Workers Compensation Insurance Carrier is unaware of the injury and thus does not start temporary disability benefits or direct medical care.
An injured worker needs the assistance of competent counsel familiar with the Workers Compensation Court. Receipt of benefits by an injured worker, on occasion, depends upon having competent counsel who knows who to call and what Motion to file to ensure that workers compensation benefits flow without interruption to an injured worker.
